Welcome. You are joining those of us who understand the value of test skills training. To protect and preserve the quality of the The Test Camp (TTC) experience, we ask that you read through, and agree to, the set of rules below; the current Terms of Service. Feel free to come by the Camp Office if you have questions, ideas, or suggestions for improving this document. Leave a Written Message and expect a prompt reply. Thank you.

TTC Experience
You are agreeing that you understand your role in helping us maintain a high quality TTC Experience.
Can you expect a high quality experience? Yes. We are continually working to maintain and improve 100's of activities & exercises, and 1000's of test items. Our technicians work to ensure that you can navigate to each area, view the content, and manipulate every exercise. You can help improve the TTC Experience for everyone! If you encounter an issue, please Leave a Written Message at the Camp Office. We'll investigate, make the improvement, and report back to you. Thanks!

Admission
You are agreeing that you will call or Leave a Written Message at the Camp Office if your pass does not provide proper admission.
Report that you are unable to gain admission with two (2) working days and TTC will consider extending your admission period.

Technical Assistance
You are agreeing that you will contact us at the Camp Office if you need technical assistance.
We are committed to keeping the website compatible with all modern web browsers. This includes, but is not limited to, Firefox, Safari, Chrome, and Internet Explorer. We make our best effort to give a near-identical experience across each of these browsers. However, it is impossible to compensate for the lack of web standards support in some of these browsers. If your browser does not support certain web standards, we will attempt to include a generic workaround. This might slightly degrade a specific function/feature, but not your TTC Experience.

Passes - Obtained by Parents & Guardians
You are agreeing that your child will abide by the rules.
If you are a parent or guardian and you provide consent for your child to visit TTC, you agree to be bound by these Terms of Service.

Passes - Obtained by School Personnel
You are agreeing that each Test Camper will abide by the rules.
If you are school personnel who provide a STUDENTS pass, you agree on behalf of your institution, that each student is bound by the Terms of Service. Your institution might instead propose a unique and separate written service agreement with TTC that accepts the Terms of Service on behalf of the students.

Sharing TTC
You are agreeing that you will not share (or sell) your TTC pass or site content.
If you would like to share the TTC Experience, please guide your friends or colleague(s) to our site. There they can explore a Visitors Campsite. Feel free also to send them to our Camp Office. Thanks.

Email Account
You are agreeing that you have an email account that you can monitor.
The Test Camp regularly sends email notifications. For example, you are immediately admitted to TTC when you get your pass. You will receive an email message with instructions on how to get started. Therefore, it is important to regularly monitor your email account. The Test Camp News, is also delivered via email.

Newsletter
You are agreeing that you understand our newsletter subscription and delivery practices.
The aim of our newsletter service is to keep our campers and visitors updated about promotions, new campsite openings, special offers & promotions. The subscription to our newsletter service is not mandatory.

Subscription
You are automatically a newsletter subscriber when you enter TTC. Note that you can delete your subscription anytime.We also reserve the sole right to unsubscribe users from our newsletter service, without notice. We occasionally unsubscribe users registered with falsified data or whose pass is no longer valid.

Delivery
Constant delivery of email might cause SPAM to your email account. Therefore, we plan to deliver The Test Camp News weekly. You might expect a modified format, suspended regular delivery, or a Special Edition from time to time. If you aren't receiving your newsletter, you might check your SPAM or NEWSLETTER folders.

Privacy
You are agreeing that you understand the TTC privacy policy.
We do not, and will not, communicate, spread, publish, or otherwise give away your information. This includes your email address and data generated during your TTC Experience. Please be sure to visit our Privacy area to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

Site Upgrades
You are agreeing that you understand that maintenance is required to keep the site functioning properly.
The TTC Tech Team conducts regular renovations and repairs to the site, usually at an off-peak time. Notifications are posted to the site if a brief interference of the TTC Experience is expected.

Reliability
You are agreeing that if you experience an unannounced service interruption, you will Leave a Written Message at the Camp Office.
Although we work diligently to provide uninterrupted service, we can’t guarantee that the site will be up and running 24/7. We depend on other companies for support, e.g., server hosting and data storage. Therefore, TTC can not be liable if the site is unavailable, or for any data loss that may occur.

Terms of Passes
You are agreeing that you understand that passes might change.
Passes are subject to change. However, changes in admission or cost will not occur for current Campers.

Service Disruption
You are agreeing that you understand that service might be temporarily disrupted.
The Test Camp reserves the right to, temporarily or permanently, modify or discontinue, a particular service. However, service discontinuation will not occur for current Test Campers.

Terms of Service Changes
You are agreeing that you understand that this Terms of Service Agreement is occasionally edited.
TTC reserves the right to change or modify our current Terms of Service without prior notice. A notice titled, Last Edited on, will appear at the bottom of this document.

TTC Property Rights
You are agreeing that you understand the policies and consequences related to TTC Property Rights.
We are serious about protecting the intellectual and content property that is helping promote testing skills via this site. Therefore, we are making clear that all site content, including all imagery and documentation, published on TheTestCamp.com is the property of the USA-based company, The Test Camp, LLC. So, your pass provides use of site content. However, Test Campers do not take ownership of site content for other uses. Below are the legalities associated with misuse of property rights.

Arbitration
If you are a U.S resident, you are agreeing to the arbitration provision below.

We Both Agree To Arbitrate
You and The Test Camp agree to resolve any claims relating to these Terms of Service through final and binding arbitration. There are some exceptions. See the section below, Exceptions to Agreement to Arbitrate.

Opt-out of the Agreement to Arbitrate
You can decline this agreement to arbitrate by sending us a statement of your intention to opt out. Send your name, address, and email address, to the below postal address within 30 days of first accepting these Terms Of Service.

Arbitration Procedures
The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. The arbitration will be held in the United States county where you live or work, Brevard County (FL), or any other location we agree to.

Arbitration Fees and Incentives
The AAA rules will govern payment of all arbitration fees. The Test Camp will pay all arbitration fees for claims less than $75,000. If you receive an arbitration award that is more favorable than any offer we make to resolve the claim, we will pay you $1,000 in addition to the award. The Test Camp will not seek its attorneys’ fees and costs in arbitration unless the arbitrator determines that your claim is frivolous.

Exceptions to the Agreement to Arbitrate
Either you or The Test Camp may assert claims, if they qualify, in small claims court in Brevard County (FL) or any United States county where you live or work. Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration or the informal dispute-resolution process described above. If the agreement to arbitrate is found not to apply to you or your claim, you agree to the exclusive jurisdiction of the state and federal courts in Brevard County, Florida to resolve your claim.

REFUNDS

Uncompleted Training
You are agreeing that you understand that refunds are not granted for uncompleted training.
You are welcome to engage in the free content; Workshops & Activity 1 - My Test, before using a pass for admission. You are also welcome to take any or all of the PreTests. If you decide to get a pass, a detailed description of each area is provided. The Campers Welcome Centers also provide an opportunity to learn about exercise format. Therefore, The Test Camp Advisory Board is not called upon to consider an uncompleted training refund request.

Completed Course - The TTC Guarantee
You are agreeing that you understand The TTC Guarantee policy.
TTC will refund your registration fee upon proof of failing a specific test after successfully completing the respective TTC training. If you think a refund is warranted, send a copy of your test report to [email protected]. Your counselor who will review your TTC LogBook to determine if your training was completed. If so, a refund will be issued. Note: To date, every camper who has successfully completed their test skills training ... has passed their test. 🙂 

ACCEPTANCE
You are agreeing that you understand all aspects of this agreement before entering The Test Camp.
By purchasing/using a pass, you indicate that you have read and agree the Terms of Service detailed on this page. You also relinquish any rights to subject these Terms of Service to any judgment or legal actions.
